I am a US citizen petitioning for my Indian spouse. I moved abroad to live with my spouse after our wedding in 2017. I am currently unemployed and we have a 2 month old baby (who meets requirements to be a US citizen). My parents still live in America and I visit them every year. I have also maintained my bank account and intend to eventually move to the US once my spouse gets his green card.
Our application is with the NVC now and we need to fill out an affidavit of support.
Questions:
1- Do I pass the domicile requirement?
2- Since I have no income I need external support. If I use one of my parents as support would they be a joint sponsor or a household member contributing their income?
3- If I use them as a joint sponsor, would I and my child be included in their household size? My mother has a steady income, she passes the income requirement of a 4 person household (herself, my dad, my brother who is claimed on their tax return, and my intending immigrant husband). Adding my child and I to the household size would make her income insufficient.
4- My father has a part time job, but owns a paid off house. Would he be a better joint sponsor than my mother?
