  • Travel restrictions for parents after Green Card?

    I am in the process of sponsoring a green card for my parents and I am about to submit my DS-230 and 864. My parents would like to spend most of their time here, but want to spend some time in India each year. 3 questions:

    1. I have been told that once the green card is approved, they need to migrate in 6 months. Accurate?

    2. Once they are here, is there a minimum on how many days they spend in the US each year? Can they spend 6 months here and 6 months in India each year?

    3. If the only option is to spend all their time in the US, are there negative consequences of not filing the green card application now and delaying it? Can a Visitor visa be granted instead?

    2. As long as they spend less than 6 months (even one day less) outside the US, no issues.
