  • Birth Certificate for 70 year old mother

    I am applying green card for my mother who is 70 years old. She does not have birth certificate although she has Indian Passport and have been to US 3 times(last time was in 2010).
    Do I need to get an affidavit stating there is no birth record for her? Please advise.

    You need to submit birth certificate and marriage certificate. Get the birth certificate affidavit from her relatives who is elder to her, get it notarized. Same goes to marriage certificate. That is what I did for my mom recently when I filed her GC. Hope this helps.

        As per my understanding those who are 70 yrs or above, a birth certificate is not mandatory. If there is a school certificate showing the birth date is acceptable. Should be attested with Notary. Go for affidavits in lieu of a school certificate.
