  • Risk less family green card

I am a US citizen planning to get married to a girl from India. Marriage will be in India. Like to know what will be the best option in applying for her green card.

    Assumptions:
    1. While the girl stays in India she can apply for family based Green Card through US consulate.
    2. The green card applications in India takes three months to process.
    3. Visiting visa is easy to obtain.

    Facts (I verified):
    1. There is no priority date for family based green card as it is in unlimited category.
    2. It is possible to apply for green card in US after coming to US using a visitor visa.
    3. She can apply for green card or visiting visa only after getting marriage certficate.
    4. Marriage is not yet happened.

    Option 1:
Get visiting visa. Come to US and apply for green card.

    Option 2:
Apply for green card in India. After getting green card come to US.

    Questions:
    1. Can she file for green card immediately after marriage?
    2. How much time it take for getting family based green card in India?
    3. During application of visting visa if she tells the interviewer that she will file for greencard after reaching US, will the visting visa get rejected?
    4. If the green card takes more than 3 months to process can she apply for EAD(Employment Authorization) and Advance Parole along with green card application?
    5. Is there any other option?
