  • Travel after applying green card

    Hi,

I understand that after I apply green card for my parents in US, they don't have to stay here in US and can travel overseas. But is there any restriction for their travel as they have to travel to their country of birth or can travel anywhere?

Also if I apply while they are overseas, is there still a restriction on their travel that they cannot travel other countries or visit me in US?

    Thanks!

I think you need to file form I-131 and wait for the Advance Parole document for them before they can travel overseas. If they travel before getting the AP the application will be considered abandoned and then you will need to do consular processing for them.

If you need to do consular processing, they can travel to USA if they have a visa and they can convince the officer that they are only there for a short while and will return to their country. If the officer is not convinced and thinks they are here to immigrate, the officer can send them back at the PoE.

I think there is a list of countries that the USA do not recommend to visit and some that has immigration issues, I will try to avoid those.

All this information is from reading, no expert experience. From what I read is better to wait for GC in the USA, many parents don't need to go to interview if the documents are complete.
