This forum has been very helpful for me during my adjustment of status process. Unfortunately, as our marriage is broken beyond repair my husband and I have decided to withdraw the family-based adjustment of status petition and get a divorce.
We have been scheduled for a second interview on the 24th of June to which we do not plan to appear as we will be withdrawing the petition before that. From my understanding, once the petition is withdrawn I may be placed in the removal process ( I overstayed my visa ) until I get a court date with the judge.
My question is this -
As my passport is expiring in less than 6 months I need to fly directly to my home country from NY, however, I do not live in NY so I need to get there first. I am fearful that I may be detained by USCIS/ICE once I try to board the plane to NY while in removal. I have already booked the ticket from NY to the home country.
Should I just not risk it and take a train/bus instead? What would happen if I do not appear in court? Even if I do appear in court I do not plan to ask the judge to pardon my removal, as I want to go back to my home country. I am trying to understand what's best.
Would hate to have more complications regarding this, I just want to get this over with and go home.
