I-130 ? regarding sponsoring for parents ?

  • I-130 ? regarding sponsoring for parents ?

    Hi All,

    I'm helping my wife who is a US citizen fill out the paperwork for her dad and have a question. On the latest form bottom left from USCIS website dated 2/13/19.

    -Part 2 40.a. if you are a law permanent resident complete item 40.a-41. This section is NA to her right since she is a US citizen already?

    -Part 4 25.a and onward should be all of her dad's kids including her the petitioner right? no need to include her mom since she was included on 21.a (spouse 1). Her parents are together never divorce.

    -Part 5 other information 1. have you ever previously file a petition for this beneficiary or other alien? does this count non-immigrant visa B1/B2 tourist visa? She filed a tourist visa for her dad back on Sept 2018 but did not pass his interview so do i answer yes or no or is it strictly asking for this I-130 petition? This is her first time filing the I-130


    Thank you all so much for your input and help. Just making sure i get this right. Ball park how long does it take when we file and until he gets a interview date if everything is done correctly and all fees paid and no issues with USCIS and NVC asking for additional document is it a year or safe to say 2yrs changeability Vietnam country?

    Also besides her copy of passport, birth certificate that shows her dad's name and her dad's certificate showing her name, what other documents does she need to submit with this application? do we need to submit pictures of her and her dad together?

    Her mom should be included too along with her dad's kids, since it says beneficiary's spouse and children.

    This is about immigrant petitions. So it would be no.

    It used to be around a year. But now, not sure.

    Since this is for a father, it also needs the marriage certificate of her father with her mother.

      Thank you so much senior you are the man! One last bug, if my wife doesn't want to sponsor her mom now but only her dad because of some business her mom has to take care of back there, will this be an issue later on when she sponsors for her mom at a later date? She is also sponsoring for her siblings with her dad so it'll be costly now around $2000+ in filing fees.

        There's no issues with petitioning her mom later.
