  • Family based greencard and H1B extension

    Hi,

    I am married and currently on H1B and my wife is on H4. Both my wife and me have siblings who are US Citizens. Should we wait for my employer to file for our GC or should we ask our siblings to do that for us? I read the earlier posts which state that brother-sister application takes about 11-13 years. What is my best bet? Employer Based or Family Based?

    If Family based GC has been applied for, if I can, how many times and for how long can I extend my H1B?

    It would be best to have both filed.

    Filing family based green card does not specifically give you any extension rights. You will run out of H1B waiting for this to get current.

      Thanks for the prompt response!

      If I don't have any rights to file for an extension with Family based GC application, there is no point in applying both ways (Family based and Employer based), is it? Please correct me if I am wrong.
