Joint Sponsor (Married filing Jointly) Form i864 & i864A

  • Joint Sponsor (Married filing Jointly) Form i864 & i864A

    Hi guys Please Help...

    My joint Sponsor file taxes as (Married filing Jointly). Even though his Wife never Worked and she has no income.

    Is it must that his wife will fill form I864A (Household Member)? IF "NOT" then in which way to fill form i864 so that CO won't ask for i864A at interview?
    As I have seen many people getting 221g for form I864A.

    IF YES
    Then

    1) Would my Joint sponsor add his wife on form i864 Page No 4, Part 6 (Sponsor's Employment and Income) Person 1 (Name and relationship)?
    But her (current income) will be Zero right?

    2) Would my joint sponsor check the box Page No 5 Part 6 (Sponsor's Employment and Income(continued)) box no 21?

    3) Would her spouse check the box "Yes" or "No" on form i864A? because they filed taxes jointly.

    5) would i Just need my joint sponsor and his household member(wife) Proof of U.S status or their proof of relationship is also required?

      If the joint sponsor's wife has no income, no I-864A is needed from his wife.

        But i want to do i864A because i don't want to give any chance to CO to refuse my VISA. can You please tell me the answers of my questions? Please

          The I-864A is for a Household Member, usually spouse, who has income to contribute to the sponsorship process. If the spouse in this case has no income, you can still complete an I-864A for her, include proof of her U.S. status (citizen or immigrant) and copy of marriage certificate, and show her income as what the tax return shows as total income for her family.

          In the past, USCIS would someitmes insist that non-earning spouses provide I-864A forms, but that seems to be a relic of past procsssing and doesn't seem to be requested anymiore.

            My joint Sponsor file taxes as (Married filing Jointly). and his wife does has income. Can you give advice on the forms Abdul_Basit asked above? Because the adjusted Gross Income are a joint number, I'm really confused how to get this questions answered. Please help!

              I'm currently in a similar situation. I'm using my brother-in-law as a joint sponsor however for 2020 he and my sister just filed jointly. if his income meets the requirements, does she still have to fill out a i-864a?
