  • Military spouse overseas | affidavit

    Hi,

I'm a US citizen and petitioning for my parent (i130) but my sole income won't be enough to sponsor him so I'm filling an 864A (household member) along with the 864 to include my husband's income. We've filed jointly for the fast few years and have lived together since we got married. The form says a household member is someone who lives in the same house (which my husband permanently does) however this year he was deployed with the US military and his physical address is out of the country and will be that way for the next months. Can I still count him as a household member or should he file a joint sponsor affidavit instead?

    Thank you

Your spouse is always a household member even if they don't live with you.

This is my personal opinion and is not to be construed as legal advice.
