  • PD is current but I-130 pending

    Greeting, my mother filed an I-130 for me on January 17th 2018 and by seeing the visa bulletin, my Priority Date is current. However, i'm following consular processing and so I can't file for an adjustment of status since i'm living overseas. If there is a cut-off date retrogression and my PD isn't current anymore when my I130 gets approved, will I have to wait for the rest of time ? Any help would be greatly appreciated since I would greatly appreciate doing an exchange to the US from my european university exactly after getting my Green card to get my degree, and then finish up my studies in the US.

    I'm not familiar with consular processing, my guess is that once the I-130 gets approved then you need to update documents so they can check your case and schedule an interview at your consulate. They may or may not schedule an interview if the PD is not current. Definitely they will not approve your immigrant visa until the PD is current. Once you get your visa you can pay for your GC and travel to USA, you will get the GC in the USA after a few weeks/months.

    The retrogressions are out of our control and I don't think you can do anything to speed up the process. Good luck.
