Request for 2018 tax transcript -- but that won't be available until Nov/Dec, 2019

  • Request for 2018 tax transcript -- but that won't be available until Nov/Dec, 2019

    Synopsis:
    • CR-1 (US citizen sponsoring spouse case), Consular Processing in India
    • I130 filed in July, 2018, approved by USCIS in March, 2019.
    • NVC accepted all civil and financial documents documents in May/June.
    • I have already submitted: Form I864EZ, 2018 W2, 2017 tax transcript, and 2019 payslips. Income is 10 times the required level. All these have been accepted.
    • NVC has asked for 2018 tax transcript. However, my taxes won't be filed until October 15, 2019 (the due date with 6 months extension).
    Consular interview not yet scheduled -- unclear if the delay is due to 2018 tax transcript not being available.

    So, what can be filed in lieu of 2018 tax transcript? They have already seen everything that is available...

    8/8/18 I797C (Notice of Action received)
    3/29/19 I130 approved
    5/15/19 NVC case/invoice email received.
    5/19/19 Paid all fees, submitted AOS, Civil Documents and DS260
    8/14/20 NVC marked the case complete, waiting for visa interview date.

    Total wait: 26 months+ ... still waiting! Who knows when, due to covid

      I also had an extension for my taxes. My lawyer advised us that we had to file our taxes before we could submit. USCIS doesn’t care if the IRS agrees to give us an extension.
