    Hi,

    I have applied GC for my parents concurrently I-130 and I-485. They have got the biometrics done today, 3/22/2010. Can you please tell me what will be next step. Also my mother's I-94 is expiring on May 25. She does have a valid 10 yr visa. Do I need to apply for Visa extension while they are wiaitng to get her GC processed. Also what questions do they usually ask when they go for the GC interview.

    I had posted a similar question few weeks back. I was told (on this forum) that once you file I-130 and I-485 you cannot leave the country. I am assuming that this means no extension of visitor visa is required as you are in 'AOS pending' status.

    Can you post the timeline? (When did you mail the application, when you got the I-130 approval, notice for biometric etc.)? Also, what center are you under?

      Thanks for your reply. My timeline is as below:

      02/27 - application sent for 130 and 485
      03/09 - Check cashed
      03/12 - notice received for I-130 and I -485 with receipt numbers
      03/20 - Finger print notice recd
      03/22 - Finger Printing done in USCIS office, Alexandria, VA

      Can you also post your timeline and where you are.

        Concurrent Interview

        From what I hear, you normally dont get called for interviews for parents GC. Only possible reason if your parents just recently got a tourist visa to enter US. Even that is remote. When did your parents get their tourist visa?

          03/12/10 Receipt date
          03/18/10 Checks cashed
          03/18/10 Notice date for I-130 and I-485

          No FP notice yet.

          I am in Phoenix, AZ. The application was mailed to Chicago office.

              03/18/10 Notice date for I-130 and I-485

              Don't remember when we did the FP.

              We a got a RFE and after I send the information requested now I've recieved an Interview notice for next month.

              1. Does anyone know what kind of questions they ask?

              2. All the documents listed on that checklist have already been submitted. Do we need to take anything with us?

                Apply I-130 or NOT apply?

                My mom has been in the US for 2 years now. She came with a tourist visa to see her grand kid (my son), but she overstayed her visa. Now I am a citizen and just had another daughter who is gratefully watched and cared for by my mom. Can I pursue a concurrent i-130 and i-485 application for my mom without running the risk of expulsion? Or should I just submit the I-130 application for ICIS review before attempting the I485?

                  Start a sepearat thread for this issue. You might want to search this forum as well. If I recall correct, there are some major issues with someone overstaying longer than a year. There is a mandatory deportation and wait for certain number of years. But I am not a lawyer and have no legal knowledge about this situation. If I were you I would talk to a lawyer (wait if I were you I would've sent her back before her I-94 expired). Talk to a lawyer. Don't go by the freebie advice you get on forums. This could be a serious issue.
