    Hello everybody,

    Can we file a form I-130 when we are living in a different state.

    I have a F-1 visa and my spouse has a green card. I live and go to school in Georgia and my spouse lives, works and goes to school in Maryland.

    Any help will be greatly appreciated.

    Hello, It does not seem that you are truly married if you live in different states. How can you prove that you are in a REAL relationship when you are not together. I know that there are many reasons to be apart BUT USCIS may not believe that this is a genuine marriage. I am not trying to be cruel but they look for fraud marriages and sometimes ask tricky questions at the interview. Good luck.

      I think this question would be better suited for the "Family based Green Card" forum instead of the K-VISA forum.



      My wife and I went in for the AOS interview this month. We got a Request for Additional Evidence form, for more evidence of co-habitation. I dont know if you would have to prove cohabitation at the time of filing the I-130 but I think it will be a likely requirement at your AOS interview.
      My Fiancee arrived here on a K-1 VISA.
      Conditional GreenCard has been received.
