  • F2B case ... Marriage and then Divorce

    Hello from California
My mother-in-law (on green card) filed a case for her son under I-130 F2B category (above 21 years unmarried) in 2016. We received receipt (I-797C) within a month. Till today (2019), we have not received any approval and the website and on phone, we continue to hear same response that the case is under processing. Here comes the complication! Next, her son married in 2017 but unfortunately got divorced in 2018. My mother-in-law is still on green card.

So I have 2 questions and would greatly appreciate help from folks!

    1. Based on the above situation, is the original I-130 petition filed in 2016 (priority date of Mar 2016) still valid? After divorce, the son is back to unmarried status and single (no kids born either)
    2. If the answer is Yes, what's the best way to approach USCIS? Should I explain to them this marriage and divorce situation? USCIS has been quiet for the last 3 years now ... what can I do to get some traction? Hire a lawyer? Figure out a way to go to the field office?

    Heeeeeeeeeeeeeeelp!
