    Hi i am planning to petition my father from the Philippines on a IR 130 i am a us citizen now so my question is can he also bring his minor children? since wife is deceased can it be a hardship to leave them?
    and if not why

    Father qualifies as immeidate relative. Immediate relatives can not have derivative beneficiaries. Therefore, he can not bring his minor children with them.

      thanks for your help guess got another question
      once he is in usa and files for the children what happens when they turn 21 during the process do they become Void?
      right now the children are 14,17,19 will it start when petition is approved?
      or date of interview etc
