Sponsor in India

HI.
i spouse(sponsor) is a US citizen and now is in india. can i still file for 1-130 and all other documants...!!!
or do i need to file them from India or is it better wait till she gets back.

For how long is the sponsor staying in India?

she's planning to stay till August and my H1B is expiring on Sep5th. that;s why i was planning to file those before it expires.
i do carry I-140, i know it doesn't count if i am out of status.
