i have overstayed my tourist visa,now i just get maried to an usc woman.
we are going to file the forms i 130 and i 485 for aos.
but i have the following problem:i didn`t go to the special registration (in 2001 and after 9/11 the deparment of justice ask non immigrants of some countries to go through a special registration with immigration),because of fear of being deported.i was 16 years old.
i need some advice from someone who is in the same situation.

Complicated!

Once you file for AOS, you may receive RFE for NSEERS (special registration). Further processing of your case may be delayed until you provide proof of NSEERS. In this case you will have to go to the ICE office having jurisdiction over and do a late registration. But there can be complications, as you may be detained based on numerous factors, like criminal record, willful failure to register, etc. Either way, they will register you and write down FIN# on your I-94 and on your passport. USCIS needs a copy of your I-94 and your passport showing that FIN# hence fulfilling the requirement. If you are detained, you may be give a NTA and put in removal proceedings. And at the same token, if you don't provide proof of NSEERS to USCIS before the expiration of RFE, USCIS can deny your AOS and start removal proceedings against you. This is a very serious situation and I will suggest you must hire a competent immigration attorney for your case. Ask around your community and you may be able to find one. Good luck!
