My husband and I are both naturalized American citizens since two years. I'm now sponsoring my mother for her GC. I'm not employed and I've never been either. My question is what are the forms required on my behalf to file for "Affidavit of support"? We have a house but it is on my husband's name. We have been prompt in filing taxes so far for both of us. Am I still eligible to sponsor my mother since I'm completely dependant on my husband financially? If so, what form needs to be used by my husband to act as a co-sponsor for "Affidavit of Support"? Please ..... any help is greatly appreciated as I'm running out of time since its already three months since my mother came here to visit us. I would also like to add that my mother is a widow. Does that help in anyway? Thank you v.v. much!

I have read those guidelines...but I need to know if I qualify to sponsor my mother, considering my financial status. If so, do I need to provide two copies (one for my I-864 and other for my husband's 1-864A)of tax returns, W2, bank statements (my husband and I are joint a/c holders), etc etc.. Would it also help to make to change the ownership of the house to a joint ownership...please...help!!

Thank you for ur prompt reply. I have some more doubts- since my mother is already here on a visit visa for six months, (three months are done), we are applying the I-485 alongwith the I-130. On the Part2 of the I-485 application, we could not decide which answer to choose from.
Is it better to do this (or) do it separately?
Secondly,do I need to attach I-864 alongwith I-130 also?
Thirdly, should the cheques be made out separately for each form (for ex: I-130, I-485 etc.) or just one cheque altogether?
Please reply soon since we need to roll out the papers next week earliest. Thankyou.

...I'm looking into the details...thnx.
My mother's visit visa expires on July 17th. Would there be sufficient time for us to file the AOS alongwith the immigration petition, before her visa expires? Do I need to extend her visa before I do the AOS filing?
After I send the forms for I-130 and I-485, how long does it usually take for the Approval Notice? It is my understanding that once she gets the Approval Notice, her vsit visa is void, and hence her status changes. Does that mean she could continue to stay in the U.S. inspite of her visa expiration, after receiving the approval notice. Please advise.

As long as you file I-485 before her I-94 expires, she will be in legal status and she can stay.Immihelp Support
