  • Fiance with EAD status

    Hi All,

I am in US since 2007 working for a parent company based out of India (I am currently in US and currently working for a client in US and have my VISA active till 2012.....). Here I met a girl and am planning to get into a nuptial relationship. She has been here since a long time and applied for GC. However currently she has acquired EAD and waiting for her GC.

Can anyone please help me to understand what is the best move. Should we get married and apply for my EAD or apply a Fiance VISA and wait till she gets her GC.

My question here is if I get married to her can I be eligible for applying a GC or do I need to wait till she gets her GC for my status change. What is the best move for us in this matter. Please advice.

    thanks a lot.

as far as i know, get marry and apply/add you in GC process is better.
once she/he obtained GC, you will have to wait till citizenship for your process makes easy...which will be another 5 years away after obtained GC.
there is lot on info here...please read as well.good luck

        EAD for spouse

Hi, Really thanks for your response, however the answer is not so clear or I am not able to get what you are trying to say. Probably my questions are not so clear, let me rephrase my questions againg......

        1. If it is only 1 yr after getting the EAD, and he/she gets married to an individual staying in US on L VISA, what would be the status of the spouse if he/she is added to the GC process.
        2. Once added to the GC process, would the spouse be a dependent or the spouse would get an EAD to work.
        3. If the spouse does not get the EAD are there any alternative ways to get authorization to live and work in US with the spouse who is in the process of GC.

        Thanks in advance

          Wait!

If you marry a LPR, you will fall under F2A category. Please read this link https://www.immihelp.com/family-base...ategories.html
