  • Last name spelling not matching

    Hi,
Recently i got citizenship, i am planning to apply Family based green card (F-4) for my brother and family. I realized one letter in my brother's last name is missed. But it pronounces same as mine. I've 'thya', but he has 'tya'. That is how he has in Birth and education certificates, passport, etc.. We never cared this since he has no plans to come abroad.

Do you think it may create problem (since there is no exact last name match) if i apply for Family based Green card ? Before applying do you think its better to correct in his Birth and Education Certificates, passport, etc.. ?

    Thanks in advance..
    Kiran

If you're referring to a spelling mistake that you made in paperwork for the F4, then it's a problem. But if you're asking whether the same last name spelling is mandatory to file a F4, then that's not true. Your last names don't have to be the same. You will need to show the correct birth certificates and establish parentage and all that for eligibility. In fact, you don't even need last names to match at all. They're just names... nothing else.
    --Good luck--
Good luck. I learned the hard way, I hope you don't have to. Immigration is interesting. Not considered as legal advice.

Thank you Kumar for quick response. I was really worried about correcting his last name in all certificates.
