  • Filled I-130 for son unmarried older than 21 when he was in a country in Rest of

Dear Community, first of all, thank you or all clarifications you provide to this community. That is very helpful for whom is going through this important process.

I would like to ask one thing:

My mother (US citizen) filled I-130 for son unmarried older than 21 (me) when I was in a country in Rest of the World, now am living here in the US. According to the VISA Bulletin predictions from January, my date will be available in the February bulletin. I have some questions about what happens next:

1 - I have updated my address at NVC/USCIS so they now my current US address. Are them going to send me an e-mail or mail providing me future directions?
2 - When the official communication is going to arrive to me? February the 1st?
3 - Are they going to tell me to go through the Consular process or are they going to tell me to go through the I-485? (I am living here for the past 2 years studying in a university using the F1 visa.)

Thank you very much for everything and I wish you all a great new year.

    Kind regards,

What country you are "in" is irrelevant. It's your country of birth that matters for determining availability of visa numbers.

If you are in the US and in status and you are doing Adjustment of Status (I-485), you do not need to wait for any communications. If the date on USCIS's AOS filing chart passes your priority date for a given month, you can just file I-485.

This is my personal opinion and is not to be construed as legal advice.

Thank you very much. Are you sure that I should file without waiting the official communication? How long it takes to receive the official communication from them?

Yes, for I-485, you just file with the I-130 receipt/approval. You only wait for communication if you are doing Consular Processing abroad.

This is my personal opinion and is not to be construed as legal advice.

Newacct, thank you very much for all your help. I will be sending the I-485 and the I-864 all together to the USCIS at Chicago tomorrow and I am very excited about this. Thank you very much.
