Being denied due to spouse's sibling?

I am in the process of applying for green card for my spouse, and recently found out that a few year's ago, my spouse's brother outstayed his work visa in the US. He used to work for a foreign company's US branch. When he quit his job, he did not leave the country when the visa expired. In fact he outstayed the visa for quite a bit and now he is not allowed to enter US territory again.
I'm not sure if they can link the two of them together, but they did ask for the parent's name and address so if they want they probably can.
Would this effect our application? Has anyone heard of similar cases?
