  • minor child (of US citizen) living abroad

I became naturalized US citizen in May, 2007. I am a father of a 13yrs old child who was born in January, 2007 to a non US citizen mother. We weren't married at the time; but eventually got legally married (in Virginia, USA). However, because of career demands, my non US citizen wife lives and work abroad, our child staying with her. I live and work in the USA

I am wondering if any one has experience regarding using Consular Record of Birth Abroad (CRBA), does my child qualify for it given her birth and circumstance? Any ideas about the best path for my wife and i to bring our child to the USA?

I read somewhere a visitors visa for the child might be a challenge because of perceived intent to migrate (due to US citizen father) ? My wife travels back and forth to the USA without any problem.

    Any help will be appreciated

I believe the important fact for the CRBA is that you must be a citizen before the birth of your child. Please take a look into that requirement because it looks like you became a citizen after he was born.
    --Good luck--
Good luck. I learned the hard way, I hope you don't have to. Immigration is interesting. Not considered as legal advice.

CRBA is only for people who were already US citizens at birth. Your child is not a US citizen at birth, nor a US citizen now.

By "bring your child to the US", do you mean for him/her to immigrate (relocate permanently) to the US? If so, the best path is for you to file I-130 to petition your child to immigrate to the US. When he/she enters the US on his/her immigrant visa, he/she will immediately become a US permanent resident, and also immediately become a US citizen under INA 320 as a permanent resident under 18 living in the US with a US citizen parent.

Visitor visa is not appropriate if your child intends to immigrate to the US.

This is my personal opinion and is not to be construed as legal advice.
