I-130 filed for my brother got declined. Need help !!

Hi,

I applied for I-130 for my sibling (brother) in December 2006. I just checked the status and they say it is declined. They wanted certain details (birth certificate from govering authority) but communication went to my older address...I have moved to new address ~one year back so....

It got declined 2 weeks back. What are my options now ? I hate to lose 4 years of waiting gone in vain....This would terribly impact my brothers and their young children in India.

Any help would be highly appreciated.

You should always keep your address current with USCIS, if you have any pending petitions.

You can file motion to repoen (MTR). It may not be an easy thing to do youself. I recommend you hire an attorney.

Thanks. Does it gurantee to get the favorable decision ?

I saw. The charges for I-290B are $585. By filing that, is it guranteed that they would open the case as expected ? They can deny the re-open motion, right ?

All you can do is try. There is no other better option.
