Can I ask you a question? Did your siblings submit PCCs along with their DS230? If so, were they able to obtain the same from the passport office? I hear passport offices insist on interview letters. Did that happen in their case?

    Thanks
Yes After submitting I864 & DS230 we got a letter from NVC saying they need some more documents with a barcode sheet and stuff. We got the PCC based on that - then we sent it over to NVC. Now we have a letter from them saying our case is complete!
From what I understand, if you can prove (with any document) that your case is in line for an interview - they will give you the PCC.

Husband is an Indian citizen living in UAE. He is currently in India on a visit and we thought it would be a good idea to get the PCC now. Is it too early? How long is PCC from India valid? Are we supposed to send the originals to NVC?

        Thanks again.
I have send my original PCC to NVC as it need two sets of document one in original and other in PHotocopy but make sure that u make photo copy of PCC some extra and make it true copy of it....... about the validity and other first things u wrote please consult some good expert regarding this or search in this forum there should some same cases

          • Is there anyone who filed their I-130 in Aug 2010? I still have not received an approval letter. I contacted my lawyer who said it is taking up to 18 months for approval and many of clients are still waiting as well.
Should I contact the USCIS myself? What should I say when I call them? So scared that its taking this long.

sahsan!! you should call them asap! through which service center you are applying? It should not have taken more than 5 months to get the approval letter.

                • newborn baby question

                  Hello everyone,
I filed I-130 for my wife. After about 4 months it was approved. The case was transferred to NVC. I submitted all the required documents, and after about 3-4 months our case was completed. I was expecting that the case will be transferred to Consular in my wife's country. I didn't receive any correspondence so I emailed the NVC. They emailed me back stating that my wife was placed in the documentarily qualified queue, and bla-bla-bla. I am sure you guys all know about this retrogression thing.
I also applied for USC a few months ago. I am expecting to have my interview in about a month. I know that I can expedite the process with my wife right after I become a USC by means of upgrading of my application from F2A into Immediate Relative. On the one hand it sounds pretty nice. But there's more to it.
My wife recently gave a birth to our baby. When I emailed NVC to update them about the change in my family situation, they responded asking me to send them a copy of my newborn daughter's birth certificate. Thus, in this way they can add my daughter to my wife's application as a derivative applicant.
My question is this. What will happen If I add my daughter to my wife's application now and after a few months become a US citizen? Will my daughter still be a derivative? Or will I have to file a separate I-130 for my daughter?

                  • Pulatik,

I don't know the answer to your question. But I know this. If you think your wife's GC will be approved before the child turns 2 years, the child will be given GC at the port of entry without going through I-130, etc.

                    • Do you have any legal backing for your opinion. I mean, can you give my the link to the immigration regulation pertaining to what you said. I would like to study this matter thoroughly.

                      • Following is from another website:

So, that works only if the mother became LPR before the child was born. But, since you are expecting to be a citizen soon, the child can even enter US on non-immigrant visa and become a citizen once in US. Please read the 'Child citizenship act of 2000'

8 CFR 211.1(b)(1) is the code you might want to look at. Below is from the same:

                          (b) Waivers. (1) A waiver of the visa required in paragraph (a) of this section shall be granted without fee or application by the district director, upon presentation of the child's birth certificate, to a child born subsequent to the issuance of an immigrant visa to his or her accompanying parent who applies for admission during the validity of such a visa; or a child born during the temporary visit abroad of a mother who is a lawful permanent resident alien, or a national, of the United States, provided that the child's application for admission to the United States is made within 2 years of birth, the child is accompanied by the parent who is applying for readmission as a permanent resident upon the first return of the parent to the United States after the birth of the child, and the accompanying parent is found to be admissible to the United States.

                          • Hi all

I am a LPR and would like to clarify a few things who have some experince with NVS.

I married overseas in summer 2010 however I cannot bring my wife here rightaway, so we are waiting until I become a USC. (I have 2 more years to wait)

I filed for I130 for my wife in Nov 2010. In April, I received approval without any RFE.

Today, I recieved a letter from NVS with:
                            1)Affidavit of Support Processing Invoice
2)Change of Address and Agent form DS-3032

                            My questions are:
                            1) Does receiving these forms from NVC mean that somehow we passed the long wait based on Priority Dates? (I don't think because the PR date never passed ours which is Nov 2010)
                            2) When (after approval of which step) can we say we are free from backlog delay due to priority date.

Thanks in advance for your help

No this just means that NVC has started to process your file. But you are still awaiting your PD to become current. You still have a way to go as you will be asked to fill the I-864 and the DS-230 forms and send it to NVC with supporting documents. I suggest you read this website and start collecting all the required supporting documents.

You need to keep your eyes for Visa Bulletin. This is published every month. As soon as your category's PD becomes current then and then only you are eligible for visa.
