May 2019 - I sent in the paperwork for an I-751.
Did the bio-metrics at the end of October of 2019.
No answer from USCIS until the end of March 2020, when I got the letter for an RFE in the mail.
1) I am able to apply for citizenship at the beginning of May based on the 3 year rule. I know I can apply for citizenship with a pending I-751 which was my plan from the beginning but now this RFE changed everything. The due date for sending back the RFE will be the 25th of June 2020 with the deadline being extended with 60 days because of the COVID-19. My question is, can I send the n-400 with additional evidence of the marriage? Will I get denied, because of the RFE pending? Should I first submit the RFE and then send the paperwork for citizenship? I was not able to find an answer anywhere.
2) The RFE is a little confusing to me.
a) We don't have any children but they are asking for evidence of having kids. We are thinking about having kids in the future. How should I deal with this situation? Would a letter from us on planning to have kids in the future suffice? Should we notarize that letter?
b) Leases in both names showing joint occupancy. We are seasonal workers and have lived in the same state since we got married. However we move every 6 months because of the nature of our job and we usually live in employee housing that is behind the business we are working for and when you google that address it shows the actual business. We have submitted letters from our employer saying that we both live there but I don't think it was enough since they are requesting more evidence. Should those letters be notarized? Also, we never changed our addresses with the DMV since we move so often, so we don't have proof of living at the same address. What can I do regarding that?
c) We have a joint bank account and a savings account, and I sent 5 months worth of transactions when I submitted the paperwork. Also, letters from the bank saying we have a joint bank account with them. However they are requesting more evidence on that. What can I do?
d) They requested federal and state tax returns including relevant schedules and attachments, W2 records with evidence of filing with the IRS. I already sent the official tax returns from the IRS. What is the relevant schedules and attachments? I am confused.
e) They asked for utility bills. We don't have utility bills because of the employee housing situation. We are both managers at the business we work for so our employer doesn't charge us rent when we live there, or utilities. Our phone bills come off from the same joint account, and we have a storage unit together. What can I do regarding that?
f) When I submitted the application I submitter 2 affidavits from my sister in law and a friend. However they requested for more. I can probably provide 30 of them, my question is how many is too many? Do they have to be notarized (I haven't done this with the ones I submitted before)? Can only US citizens write affidavits?
