My question is: can I work between the expiry of my conditional green card and receipt of a I-797C / Notice of Action extending my green card for 1 year pending final determination of my I-751 Petition to Remove Conditions on Green Card?
That is; will the I-797C be retroactively dated back to the expiry date of my current conditional green card?
I have a conditional green card expiring in July 2010 (being married to a US citizen less than 2 years).
I have lodged a I-751 / Petition to remove conditions on green card based in marriage in mid-May 2010 to the Vermont Service Center. It was received at the end of May 2010.
I am expecting the USCIS to issue a I-797C / Notice of Action extending my green card for 1 year pending final deterination of my petition to remove conditions. However, I do not know when this will arrive, or whether it will be issued retrospectively to cover the period from the expiry of my current green card to the actual issue date of the I-797C.
Any assistance is appreciated.
