  • Need help with question about spelling errors in birth certificate.

    I am married to a USC and live in the US. We are hoping to submit the paper work for my green card in early June. While collecting my documents, I noticed that in my official birth certificate, although my first name and last name (which is my father's first name) are spelled correctly, both my parents' names have errors - my mom's name has a space and my dad's name is misspelled and neither of their last names is recorded in the certificate. I've asked my parents to get this corrected in Chennai, India. However, because of the lockdown, it does not seem like they will be able to get it corrected anytime soon. My questions are -
    1. Can I ask my parents to send an affidavit about the errors on my birth certificate and will that suffice? Or should I wait for the certificate correction to be done?
    2. Can I send in the paperwork with my current birth certificate just to get the ball rolling? Or will it result in delays and headaches down the line?

    Any advice on this is very much appreciated.

    I would say send the documents over to get the ball rolling. In the meantime, you can ask your parents to work on an affidavit to get the correction. If the USCIS requests it, you'll have it ready to submit. If they don't request it, then you won't have to bother but you'll be prepared. I don't think it'll cause headaches down the line. the USCIS has seen many cases like this from India due to bad record keeping and management, they know that records aren't always accurate.

      Affidavits are easy to obtain. I would have your parents get this done now (notarized), and send you a PDF which you can file with the application. They can send the original affidavit & corrected birth record by mail later.
      Affidavit should suffice as there are many cases that were approved without birth certificates (affidavits were used to suffice)
