  • I-994 for elderly parent 70 years old and household member question

    Hello,
I am applying for I-485 for my mother and I see there is a requirement to fill I-994 now. She is currently visiting me on B2 since last 4 months. Can I include myself as her household member on this form which will assist in providing the income needed?

She is not employed nor does she expect to be with her age. I have her health insurance in US already.

Please help. I really need to prove that she will not be a public charge.

    Thank you for your help.

You will be counted in her household if you are sponsoring her with the I-864 affidavit of support. If so, then yes, she's your "responsibility" in terms of financials.
    --Good luck--
Good luck. I learned the hard way, I hope you don't have to. Immigration is interesting. Not considered as legal advice.

According to the I-944 instructions, that will only be true if the OP is providing 50% of their mother's support or claiming their mother on their taxes, or the OP's mother is providing more than 50% of the OP's support or claiming the OP on her taxes.

This is my personal opinion and is not to be construed as legal advice.
