  • Immigration visa expired

    Hi

Me and my family were issued immigration visa from London, UK back in December 2019 ,based on family category f3 India, which waz valid till June 2nd 2020 , however due to travel ban issued in March ,we had to cancel our flight and ws could not travel but during this period , president Trump issued two proclamations on banning immigration visas to US.

My question is now that our immigration visa is expired ,can we get it reissued from the embassy here at London once they open ? Or do we fall nder the proclamation?

    Thank you

First of all, the country-based ban (for people who have been in the UK, Ireland, the Schengen Area, etc.) is still in effect, so you would still need to go somewhere other than those countries for 14 days before going to the US.

Regarding the immigrant ban, it seems that you should be exempt since you had immigrant visas that were valid on the effective date of that proclamation (April 23), but we will have to see what the consulates say about reissuance of immigrant visas.

This is my personal opinion and is not to be construed as legal advice.

Thank you very much for your help, now waiting for the embassy to open.

So if issued can we travel or are immigration visa holders banned from travelling at the moment?

Hello SIr, My i 130 was filled in March 2018 by my sister who is US citizen at california service centre.

When would i 130 get approved and by when the visa number would be current.

My elder daughter was 8yrs and younger daughter was 5 yrs when i 130 was filled i.e in march 2018.

I think when the visa will become current by then my daughters would be above 21 yrs of age. Can I file under CSPA act?
