    Hey guys!

    I used this forum a lot back in 2017 and 2018 when I was going through my AOS, and then I kind of lost touch with the forum as I headed out to work once I got my conditional green card.

    To recap that process we had sent our initial AOS paperwork in April 2018 and luckily received an interview in July of the same year, which was approved and I received the conditional green card. I actually received the conditional GC before I even received the EAD in the mail, so needless to say I didn't need it!

    Two years later... we sent our I-751 Removal of Conditions paperwork in April 2020, within the 90 day window. By early June we received the document extending the GC expiry date for 18 months, which is the standard practice.

    At this point we were prepared for a long wait due to the backlog thanks to COVID-19 and the current Administration who are changing things day by day.

    However today, September 17, 2020 to our surprise, I received the permanent 10 year GC in the mail!

    For us the entire process has been extremely fast, but that's because our relationship is completely genuine and we showed that throughout the process, and we gave the USCIS officers no reason to think our marriage was entered in bad faith, by providing concrete evidence and presenting it in a way that showed we cared about the process.

    I think COVID-19 played a big part in Removal of Conditions however. Remember that most ROC cases will require an interview, but USCIS officers have the authority to waive it under the following conditions:
    • There is already enough evidence to decide that the marriage is authentic and not entered into for the sole purpose of obtaining a green card.
    • Neither Form I-751 nor the supporting documentation indicate fraud or misrepresentation.
    • There are no facts or issues that are too complicated to resolve without an interview.
    • USCIS has already interviewed the conditional permanent resident 2 years earlier, as part of the initial marriage green card application.
    Due to COVID-19, I believe officers are utilizing this policy more than ever, in order to clear a backlog of people waiting for in-person interviews which are currently suspended. So it seems that if you meet the above criteria, like we did, you may also get lucky and not be required to redo biometrics or complete another interview.
