  • Family Immigration (F4) with CSPA Relaxation due to Presidential proclamation

    Hello,
Due to recent Presidential Proclamation, that is to ban visa issuance to Family immigration, (from April - Dec 2020)
I want to ask you, wether after the proclamation ends and If US embassies worldwide starts to operate for Family Visa cases,

If they would allow a child who is just passed a year above (21 its CSPA calculated age)
since the proclamation was there for about 8 months ?

Can we ask them to compensate/adjust or to give relaxations for my child ?

    Thanks

There is a national interest exception to the immigrant ban to people who will age out:
Exceptions under P.P. 10014 for certain travel in the national interest by immigrants may include the following:
    • Applicants who are subject to aging out of their current immigrant visa classification before P.P. 10014 expires or within two weeks thereafter.
I think the child in your question would qualify for this exception and can get the immigrant visa now.

This is my personal opinion and is not to be construed as legal advice.

      Thank you for your reply
      I read that article.
I have a question regarding the same,

My child is still eligible (and will be upto mid 2021), although the visa is not current yet.
Its gonna be current by this end of the year

      what my Confusion is,
as per the exception rules, they would allow such applicants who are going to ageing out before the proclamation ends and after the 2 weeks for the same.

But, I think they didn't mention the delay caused by proclamation,
I am afraid if they resumed visa services and by mid 2021 (when we get a chance in embassy for interview) and at that point of time, my child ages out.

Would they compensate these 8 months (is this what this exception allows) ?
      Thanks
