  • F1 Visa marrying a US Citizen

    My son is currently on F1 visa and going to marry a US citizen. My son entered USA 12 years before on H4 (dependent) visa and he's currently on F1 visa. Because of the risks of denial on F1 visa stamping he never crossed the border after being on F1 visa. We are planning to have his marriage in India and obtain marriage certification(court marriage) in the USA before leaving for India. As it takes 10-13 months to get green card through marriage we are planning to apply for I-131 application for travel document (advance parole) . Just wondering will there be any risk on re entry as his F1 visa has not been stamped. Appreciate your response. Thanks!

    There shouldn't be any problems. But note that it can still take 6 months or so to get Advance Parole, so he shouldn't plan on going to the ceremony in India very soon.
