  • I-864. Did I fill in some of the fields correctly?

    A question from our sponsor:

I have sponsored both my parents for their green card and we are at “Submit Supporting Documents” Stage in the NVC Process. I am filling out I-864 and find it quite confusing. I have a few questions:

    1. how can I say in the form (in what part of it) for the mother , that I fill out a similar form for the father. Do I need to do this?
    in Part 3 - #1 checked, #2 - not
in part3 i put mother in Family Member1 (Principal Immigrant) ?
    Part 3 # 29 becomes 1
    Is that right ?

    2. My current income is $ 112,000 and exceeds even for both parents, but I have a working husband and three children who are studying. My husband and I share income on the tax returns:
    2017 - $ 175,370
    2018 - $ 230,320
    2019 - $ 232,420

    I indicated :
    Part 6 # 7 $ 112,000
    Part 6 # 20 $ 112,000

    Part 6 # 24a $ 112,000
    Part 6 # 24b $ 230,320
    Part 6 # 24c $ 232,420
    Is that right ?
Should I indicate my husband's income, if so where?

No. These are for the derivative beneficiaries (which there aren't any in this case.

I think you made a typo on #24a. That should be year 2017, $ 175,370. But yes, otherwise it looks right.

If you don't need to count his income in the household income (Part 6 #20) to reach the required level, then you don't need to indicate his income anywhere.

This is my personal opinion and is not to be construed as legal advice.
