F4 Family Category

I am currently working on H1B status.

My brother is going to become citizen next year. Can he file for my Green Card under family category (F4) even though I have H1B status.

He can and HE SHOULD as they are thinking of elimination the F-4 category. The wait is anywhere from 10 to 11 years. Speculations are once the F-4 category is eliminated, they will honor people waiting and will process their cases faster.
