    marriage to US citizen for someone in US

    With a filing of Form I-485 concurrent with I-130 for a marriage based green card for marriage to a U.S citizen for someone currently in the US on a visa, what would be the correct box to select on question #2 of Form I-485 ?

    Depends on what kind of a visa your spouse has. If he entered the country on a fiance visa, the answer is c, otherwise the answer is A.

      It was a diplomatic Visa that has expired over 6 months ago. Does the fact that it expired impact which box should be selected ? Thanks!
