  • I am a conditional permanent resident and want to petition my new wife.

    Hi,
I am still a conditional permanent resident (already divorced) sadly things didn’t work out. I now am married to another woman who doesn’t live in the United States. I want to petition her to come live with me. I read in this website that I can’t but there are exceptions e.g. demonstrating I married the wife who gave me this green card for real reasons and not to circumvent immigration laws. How or when is that done? When I remove my conditions for my permanent resident card (i751)? And are there any other ways?

    Thanks

If you petition your wife before you've been a permanent resident for 5 years and before you become a US citizen, you will need to submit "clear and convincing evidence" with your I-130 for your new wife that your previous marriage was not fraudulent.

This is my personal opinion and is not to be construed as legal advice.

Even if you wait, USCIS can look back and examine your intentions. You may want to speak to a lawyer about this, as you do not want to run into a question of marriage/immigration fraud.
