  • I-864 and I-864A for wife sponsoring parents living in our household

    Hello,

My wife (US citizen) is sponsoring her parents for green card. My wife is not currently employed, and has no plans to be employed (she spends all her time working to take care of our kids, dogs, her parents, grandparents, and me). As such, I am filling out the I-864A as household member so she can meet financial requirements.

Note that her parents (they are married) currently reside in the US, and further, they live in our household.

Should my wife and I fill out separate I-864 and I-864A for each parent? I'm thinking yes, but want to verify.

I was thinking I had figured out how to proceed with everything, but then came the field in I-864A about "Indicate Number" field re the number of immigrants being sponsored in the Sponsor's promise (my wife) and Household Member's promise (myself), and I started second guessing. For now, there is a separate I-864 and I-684A (as well as all other applicable forms) for each parent.

If I am on the right track and each parent should have their own set of forms, then are there any fields in any of the forms where the other parent should be cross-referenced? For example, in my wife's mothers packet (I-130, I-485, I-864, I-684A, etc.), is there anywhere her husband (my wife's father) should be accounted for? And vice versa. Should I account for "other parent" in each I-864 household size question(s)?

Any thoughts / insight / advice is very much appreciated!

    Regards

Yes. They were petitioned on separate I-130 petitions.

Not on the I-864. And the other parent should not be counted in your wife's household size unless your wife claims them as her dependents on her taxes.

There are other forms where the other parent will be mentioned. For example, I-130 Part 2 #24 and 30 will mention both of the petitioner's parents; I-130 Part 4 #21 and 25 will have the beneficiary's spouse; I-130 Part 5 #6 will mention the other parent; I-485 Part 5 #4 will also mention the beneficiary's spouse.

This is my personal opinion and is not to be construed as legal advice.
