I-130 for applying GC for father, mother no more. Marriage affidavit/cert required?

  • I-130 for applying GC for father, mother no more. Marriage affidavit/cert required?

    Do I need to provide marriage certificate/Affidavit? If it is required to provide the affidavit, the affidavit I have says " I declare under penalty of perjury that the foregoing is true and correct." Its missing the "under the laws of the united states of America" Is it a big deal?

    Sorry not a reply but a question. I have just started to look into requirements for applying GC for parents. The Marriage certificate is the one thing I am unsure of. I don't think they have a marriage certificate and it may not be easy to get one in these pandemic times. What alternatives do we have in lieu of a marriage certificate ? You mentioned an affidavit ? Is there a template/format I could use?

      Self affidavit is not valid in lieu of marriage certificate. And the two affidavits from relatives are needed IN ADDITION to the marriage certificate from what I know. There doesn’t seem to be a substitute for marriage certificate especially if you are sponsoring a father, even if mother passed away. They don’t take Death Certificate in lieu of marriage certificate nor the aadhar card or passport mentioning spouses name. And paradoxicallly, marriage certificate is not issued if a spouse is no longer alive - not even unavailability of marriage certificate, as the marriage ends with the death of a spouse.
