  • Affidavit of Support and DS-260 ---- Complicated Situation

I am a US Citizen who has been temporarily living in Canada with my husband at our house since October 2016, but with no official status beyond 'Visitor." I have never officially 'left' the US, but I work online (self-employed) for a Chinese company and file US tax returns. I want to sponsor my husband in the US, and we are trying to fill out the affidavit of support properly. The only residence I have in the US is my parents house, as I got rid of my apartment when I 'moved' to Canada in 2016. We have applied for permanent residence for me in Canada, but that is still being processed, and have both decided it would be best for us both to move to the US.

I make a low income, but our joint liquid assets are well above the 3x required by the AOS. We own a house (in my husband's name), 2 vehicles and have a significant amount in investments and cash (in his name). We intend to use his assets to cover the shortfall between my income and the poverty level.

The confusion arises in Part 4. Information about Sponsor. Since I never officially left the United States, but I have been living in Canada as a Visitor since 2016, what do I put as my mailing and physical address, and Country of Domicile? This brings up a secondary question for the DS-260

In the section on Spouse, do I put my physical address as the house we are living in in Canada? My initial reaction wants to do that since as far as I know we need to live together for at least 6 months, and we are well above that (going on 5 years off and on). There is a question that asks if 'his spouse intends to immigrate with him to the US). This is a confusing question given our situation. I want to put no, because I am not immigrating, but I also want to put yes, because we both intend to be permanently in the US together, and will involve us 'moving' there (since I temporarily live in Canada). But then again, I am also the sponsor and this seems like a question regarding a relative that might be coming with him upon immigration, and that doesn't really apply to us.

Any help would be much appreciated. Thanks in advance.
