  • Help! Question on expiring extension of conditional greencard

My wife's extension of conditional residency greencard is expiring June 14th. I understand this is normal as everything is backed up, and we can schedule an appointment within 30 days to get a stamp, this extending her conditional residency for another period of time. The issue is she wants to travel out of country around May 15th, which is when we will need to call just to schedule an appointment. I called and they won't schedule anything sooner, but did escalate to level 2 review as my wifes grandmother is aging and this may be the last opportunity to visit her.

My question is, does anyone have experience with how certain this stamp is, how quickly we can get one once within the 30 days, or if traveling on the expired one has had no issues? I understand with operation of law it isn't really expired until it has been approved or denied. We just want to book tickets as early as possible.

    Thanks In advance!

It is certain that they will give her an I-551 stamp if she can get an appointment. I don't know whether she will be able to get one before she leaves.

She remains a conditional permanent resident for as long as her I-751 is pending, regardless of whether she gets an I-551 stamp. She just doesn't have proof of it. If she leaves without getting an I-551 stamp and needs to return after the 18-month extension letter is expired (18 months after the expiration of her green card), then (unless her I-751 is approved and the green card can be mailed to her, or she can enter the US by land from Canada or Mexico) in order to return to the US, she would have to file I-131A to get a transportation letter from the consulate, which is expensive and a hassle, but doable.

This is my personal opinion and is not to be construed as legal advice.
