  • IMMIGRANT STATUS APRPOVED with Parents to Child, more than 21yrs child

    People,

here's the thing. A friend of my both parents were migrated in the US last 2006. His parents received US Citizenship by 2010 or 2011.

The mother filed an immigrant application to his more than 21yrs old Single sons, by 2013 and the application was approved by 2014. But before 2013, the dad's parents had accidents and had to require regular dialysis 3 times a week. The mom's parents applied in the Govt to be the caregiver to her husband, and continue to receive subsidy until the husband died Aug. 2020.

The thing is, her son got married by 2016, and she was not able to change the application of her son's Civil status from SINGLE into MARRIED.

Last week, the immigrant petition of my friend was approved, received a letter and has the go signal to attend the interview and process his immigrant status application.

The thing is, my friend has no intention to keep his Married Status to the US Embassy, but could anyone help or give advice on what would he do with his application? He really wanted to go to the US since his mom is the only one living in the US, though her late husband has relatives, but living separately.

We really need help for his case, what would he do. My friend has no intention to hide his Married status, but it would definitely affect his application.

    Thank you in advance!

What's your question? If he remains married, he will be in the F3 category, and he will have about 5 more years of wait for visa numbers. If he divorces, he will be in the F1 category, where a visa number is available now.

This is my personal opinion and is not to be construed as legal advice.

Sorry for the incomplete details. My friend was filed under the Family F1, UNMARRIED sons and daughters more than 21yrs old. when his mother filed the petition last 2014, he was SINGLE, but then, he got married in 2016. last week, around 3rd week of April, the approved immigrant status has arrived, giving him go signal to process his application to immigrant in the US

what will he do. he is in the Philippines?

      What he needs to file?
