  • I -130 for sibling

    I plan to apply for green card for my brother this year. The green card process will take about a decade and he wants to come here for a visit for 2 months sometime in 2013.

    My question is will the application of I 130 hurt his chances of getting a visiting visa.

    No it will not.

    Also he has to declare that you have filed for his immigration if asked by visa officer.

        His chance will be shattered , as the Visa Officer's first job is to check whether anyone applying for non-immigration visa has an Immigration Intent, which your brother surely has , so he will be denied visa.

          As long as your brother has and can prove a stable job, financial stability and a social life in his home country there should be no problem in getting a visitor visa even though he has a immigrant file. Your sibling should put in papers from his employer that he has a job to go back after his US trip in addition to his payslips, etc......
