I am filing a petition I -130 for my spouse but I have a doubt about a portion of the form that asks if I have ever filed a petition for another alien.
I did file a Petition for a K1 Visa for my previous partner 5 years ago. What happened was that right after filing it, the filing fee for that form increased, so it was rejected because the amount of the money order I sent was not correct. I never filed it again after that, never took more action on that form, and later on my relationship with that person didn't work out.
I am currently in the US with my husband and we are filing an adjustment of status for him. So on that section (Part 5 Other Information) of the I 130, should I mention that I filed for someone else previously or should I put No since the form never went through?
I should add that I asked about this to a lawyer and she said that it was not necessary for me to include that information.
