    Hi ALL,

    I am just wondering if anyone has similar experience as my dad.

    He has green card, he returned to China end of 2019, then COVID 19 outbreak, he has not returned to USA for the past 1.5 years.

    Now since the situation turns better, and I am wondering if he will have any problem if he return to USA now.

    Does anyone has similar situation as my dad? we are worry if his greencard will expire and the officer has to send him back to China.

    Hi,
    Only way is, he has to apply SB-1 visa at local consulate before he plans to travel back to the country.
    Can he able to show the evidence that will help to prove he has strong tie up such as, owning property in the U.S., filing taxes as a resident, employment, bank accounts, or family living in the U.S. Why because, when he come back to the USA, the CBP officer may verify all of these items too.

      Probably the most likely to succeed is to just fly to the US on his green card and seek entry. There is a good chance the officer will just let him in.

      He should make sure not to sign I-407 to voluntarily give up his green card, and not voluntarily depart. In the worst case, they can only give him a Notice to Appear in removal proceedings, where he can argue his case with the immigration judge.
