I-94 is expiring - URGENT

Hello,

My father I-94 is expiring on 20th Sep. Should i apply for Adjustment of Status or only apply I-130 once he go back to India. Please suggest. Any help will be most appreciated.

You can apply for his I-130 at any time after 60 to 90 days of his stay in the U.S.

Whether you want to apply for his I-485 or immigrant visa depends upon whether he wants to wait for his green card processing in the U.S. or in India.
