Hi Immi Help my name is Anthony Gali, I am from India and need your assistance I have seen your informative video in internet and wanted to ask you a question regarding the CSPA act, my father is a legal permanent resident of USA and received his GC this year, my question is he applied for an I-824 petition for me and my mother and the petition got approved and now my age is 24 years I can give all the dates and information can you please tell me if I qualify for the CSPA

I-140 petition receipt date is april/06/2007

I 140 approval date may/29/2009

Priority date for I 140 application april/30/2001

I 824 petiton receipt date nov/20/2007

I 824 approval date july/22/2010

priority date april/30/2001

my date of birth is 09/30/1985

I am unmarried male and I am the Green card holder biological son( I think I qualify for 2B category)

I request you Sir please consider my request and please let me know do I qualify for the CSPA.

I-140 is employment based application, are you sure about that. I-130 is for family based immigration. Looks like you may not be covered under CSPA as the petition got approve after you turned 21. But still you are covered under F-2B category. Secondly F-2B category covers unmarried sons/daughters of LPR. One more Very Important thing, do not get married prior to getting a GC or else your petition will be void, and you will have to wait till your dad becomes a USC then applies for you under F-3 category which may take upto 8 or 9 years. Please correct the errors (if any) then ask the questions again.

hi thank you very much for the reply, my dad is in EB3 category and applied for I-140 and received in 2009 but his priority date is 2001 it self and so with the I 824 petition same priority date exist which is 2001, my father got his GC this year as he is in EB3 category and recently we received an mail from NVC to pay visa fee for me and my mom and attend an interview at Chennai consulate, if I qualify for F2B category and the visa dates are of jan-05 till wat date do I need to wait and the I140 and I824 and I485 have priority date 2001 as well so according to CSPA act I need to deduct approval date from my present age which make my age 20 years 3 months so please correct me
