    GOOD MORNING I filed form i-130 for my brother file is approved i paid aos fees $88.00 my brother has a son 21 and 6 months old can my brothers son immigrate with him since he is over 21 now?


    If he can, what forms do I need to fill?

    Look for the rule called 'child status protection act CSPA' to see if he can

            All depends on when the initial application filed, when it got approved. Do some research on CSPA rules. You can calculate if your kids qualify also. When did your brother actually filed for you and what is your priority date? Is the I-130 approved yet?

              Mmy case date "19 AUGUST 2009 " and now i'm waiting for approval

                17 year old MAY have a chance but the other two, no chance, till you sponsor them. You have anywhere from 7 to 8 years wait.
