  • Incorrectly received 10 year green card instead of 2 year

    Hi everyone,

Last year, I received 10 year green card (Marriage based) instead of 2 year. Assuming it was error from USCIS, I wanted to know if I can directly file for i 751 to remove conditions or do I also need to file for i -90 to get correct 2 year green card?
I complete 2 years of getting green card in 4 months.

Any kind of advice is appreciated.

    Thank you!

Are you sure you are supposed to be a conditional permanent resident? So your US citizen or permanent resident spouse filed an I-130 to petition you? Did you do Adjustment of Status in the US or Consular Processing abroad? If AOS, when was I-485 approved? If CP, when did you enter the US? When did you get married?

This is my personal opinion and is not to be construed as legal advice.

From my understanding….if you were married for at least 2 years before the Green card was issued then they will issue you with a 10 year one instead of the conditional 2 yr card. Were you married for at least 2 yrs?
